Collection Fee Disclaimer

In consideration of the services provided to the customer, I/we hereby guarantee payment in full of the customer's account in accordannce with the financial arrangements made at the time of purchase(s) or, if no such arrangements are made, in event of payment default, reasonable collection agency fees equal to twenty percent (20%) of the delinquent balance and reasonable attorney fees, shall be added to the amount due on the account, plus any applicable court costs.

Disclaimer Rationale

The addition of the above Collection Fee Responsibility Notice will allow us to add twenty percent (20%), or your normal fees, to the account balance submitted to Atlas Collections, Inc. for collections. Doing so will result in a fee reduction of approximately two- thirds (2/3) that are normally paid to Atlas Collections, Inc. This disclaimer should be added to all financial policy forms that require a signature. This signed disclaimer must be submitted with the account for us to add the twenty percent (20%) onto the account.

Sub Section 808(1) of the FDCPA

The collection of any amount (including an interest charge, fee, charge or expense incidental to the principal obligation) unless such an amount is expressly authorized by the agreement creating the debt or permitted by law.
