Times and Timing of Collection Calls

Timing is everything! This is so true when it comes to the third party collection of debt for creditors. The Federal Trade Commission (FTC) sec 805 is clear to the times and circumstances that provide allowable times for phone calls to debtors.

We have heard many stories from debtors as to when we “can” call them, what we can say and that we shouldn't call them again because it was a holiday or on a Sunday. The actual rules as stated is sec 805 of the Fair Debt Collection Practices Act (FDCPA) state that the assumed convenient time for a call is between the hours of 8am and 9pm local time as the consumers (debtors) location. Call can be made on Sundays unless this known to be inconvenient for the consumer (debtor). Calls can be made at other times “if permission is specifically granted by the consumer”. (Halliday, FTC Informal Staff Letter, Feb 25,1986 should also be consulted and has been quoted in this paragraph for reference purposes.)
